In re: Power Integrations, Inc. On August 16, 2018, the Federal Circuit denied Power Integrations’ (PI) petitions for a writ of mandamus challenging the PTAB’s refusal to institute inter partes review.  The PTAB found that PI failed to establish that relied-upon references were “printed publications” within the meaning of §102 and §103, in particular whether the references were accessible to the public.  The Federal Circuit found that mandamus was not appropriate because PI sought review of the Board’s decision on the merits and that the Board’s reasons were sufficient under the Administrative Procedure Act to provide a “reasoned decision by the agency.”
